EB-3

EB-3 Skilled workers, professionals, and other workers

EB-3 Skilled workers, professionals, and other workers:

An employer may file an immigrant petition in the third preference category on behalf of skilled workers, professionals and other workers if they are able to provide evidence of labor certification, schedule A designation, or that the employee qualifies for the Labor Market Information Program.

Skilled workers:

Skilled worker positions are positions that require at least two years of training or experience.

Professionals:

Petitions for professionals must be accompanied by evidence that the employee holds a United States bachelor’s degree or a foreign equivalent degree and evidence that the employee is a member of the professions.

Other workers:

Other workers are unskilled workers and their petitions must be accompanied by evidence that the worker meets educational, training and experience, and other requirements of the labor certification.  Other worker petitions are severely backlogged and take several years to be approved.
